Most land work ends in a few documents. A runsheet lists every recorded document in the chain of title. An ownership report states who owns what and what stands in the way. Once a lease is signed, a lease acquisition report tells the client exactly what it bought. When the record leaves a question open, a supplemental report closes it.

The file below follows one fictional tract through all four, with reader's notes beside each document.

If you own land or minerals

Read the notes beside each document. They say what each part decides: who has to sign, who gets paid, and on what share. This is the same report an operator would receive. Nothing has been simplified.

If you run a land department

Turn the notes off and read it as a deliverable. Check the limits stated in the header, how open items are carried, and whether the decimals tie from the runsheet to the ownership report to the lease acquisition report.

Notes

  1. Limited search. At the client's instruction the record was run forward from the 1921 deed into Jonas P. Hallbeck. Earlier title was not examined. Indexes searched: Recorder of Deeds, Register of Wills, and Prothonotary.
  2. The 1921 deed excepts and reserves "all coal and other minerals." Oil and gas are not named. Whether that reservation reaches oil and gas is a legal question and is referred to the examining attorney. Ownership above is shown on the assumption that oil and gas passed to the grantee.
  3. Two prior oil and gas leases appear of record (1968 and 2012). No well, unit declaration, production, or extension was found for either, and neither has been released. Both appear to have expired by their own terms. Recorded releases or an affidavit of non-production are recommended.
  4. A 2016 mortgage from Daniel W. Hallbeck to Alder County Savings Bank is open of record. No satisfaction was found. Subordination should be considered at leasing.
  5. Marian H. Oster took a one-quarter oil and gas interest under her father's 1961 estate. Nothing further appears in her name in Alder County. She is believed to have died in 2011 while living out of state. No estate, affidavit of heirship, or conveyance is of record. This interest cannot be leased until heirship is established.
  6. The coal estate was severed in 1921 and was not examined.

What Makes a File Hard

The sample has one open question. Most files have several. These are the ones we see most, and none of them is unusual for us.

  • Heirs who never opened an estate

    An owner dies, the family keeps paying the taxes, and nothing is ever filed. The interest has to be traced through the family, across county and state lines, and put back on the record.

  • Minerals severed generations ago

    A reservation in an old deed can leave the minerals with a family that has not owned the surface in a century. They do not appear in the current owner's chain, so they have to be found from the other direction.

  • Old leases that were never released

    An expired lease with no release of record is still a question. The answer is in production records and unit filings, not in the deed books.

  • Interests that differ by depth or formation

    One tract can have different owners, and different leases, at different depths. Each horizon has to be run as its own chain.

  • Tax sales, quiet title actions, and court records

    Some of the chain sits with the prothonotary (the county's civil court clerk) or the tax claim bureau and never reaches the deed index.

  • Royalty and overriding interests carved out along the way

    A non-participating royalty or an override (a share of production carved out of the lease) does not change who signs the lease. It does change who gets paid, so it has to be carried through every later transfer.
